A Calhoun County, Texas jury awarded Curt Lindsey $200,000 after it found he fell from scaffolding that was improperly constructed. The jury only spent two hours deliberating and found Brand Energy Solutions to be 80% responsible and Formosa Plastics Corporation of Texas 20% responsible for Lindsey’s injuries. Lindsey was working on a piece of equipment at Formosa’s Point Comfort plant when he fell through scaffolding constructed by Brand Energy Solutions. He was flown by helicopter to a hospital in Houston after the 30-foot fall. He was treated for a day and then released. However, he later would require surgery to fix his shoulder.

Initially, the suit was filed against Brand Energy Solutions, but after they named Formosa and Turner Industries Group as responsible third parties, it was amended to include them as well. Allegedly, the evidence showed the scaffolding Lindsey fell through met neither the federal government’s nor Formosa’s safety standards.
