Fire Truck Stop Sparks Fourth Amendment Questions for North Carolina Courts.

Drunk drivers pulled over at a police traffic stop are a common occurrence. Drunk drivers pulled over and arrested by private citizens are rare, but do still happen and are constitutional. A drunk driver pulled over by a fire truck makes for a constitutional case of first impression for North Carolina courts.

In a highly unusual incident in May 2011, University of North Carolina – Chapel Hill professor of history, Dorothy Hoogland Verkerk, was pulled over by a fire truck driven by Fire Lieutenant Gordon Shatley. According to Shatley, Verkerk was driving well below the speed limit, was swerving, had her hazard lights on and headlights off, and had a window open despite pouring rain. Shatley claims that he turned on the siren and fire truck lights to prevent other drivers from passing Verkerk’s vehicle. Shatley further claims that Verkerk’s car then struck a curb and Verkerk pulled over. Shatley ran over to Verkerk’s vehicle and asked her to park and to have someone pick her up. At this point, Verkerk sped away and Shatley called the police. Verkerk was pulled over by the police and arrested on suspicion of drunk driving.

Verkerk was convicted and sentenced to 30 days in jail, probation and community service. Verkerk has appealed her conviction on the ground that Shatley performed an unconstitutional traffic stop under the color of a government official, despite the fact that Shatley is not trained and not authorized to perform traffic stops. The appeals court partially agreed with Verkerk and remanded the case to the lower court to consider whether the initial actions by Shatley violated the Fourth Amendment prohibition on illegal searches and seizures – an issue that the lower court had not considered.

If the lower court finds that Shatley’s actions violated the Fourth Amendment, then the subsequent police stop and arrest were also unconstitutional under the Fruit of the Poisonous Tree doctrine and Verkerk’s conviction would likely be vacated.

Massachusetts Woman Settles Flesh Eating Bacteria Medical Malpractice Lawsuit For $9.5 Million.

Monica Sprague Jorge endured one of the most horrific cases of necrotizing fasciitis, commonly known as flesh eating bacteria, after her doctors performed a Caesarean section while Jorge was giving birth in 2007. Jorge has now settled her medical malpractice claims against the doctors for $9.5 million.

In August 2007, Jorge arrived at the Emerson Hospital in Concord, Massachusetts to give birth. Jorge’s doctors decided to perform a Caesarian section to deliver Jorge’s child. During the surgery, Jorge contracted necrotizing fasciitis, a frightening infection that kills flesh and organs at a rapid pace. As a result of the infection, Jorge lost all of her limbs and several internal organs. Jorge’s hands had to be amputated to the elbows.

Jorge sued four doctors and five nurses for negligence and medical malpractice in causing Jorge’s horrific personal injuries. Jorge argued that the medical professionals in charge of her care failed to monitor her situation and failed to provide adequate care. The doctors and nurses defended their performance by stating that they were not negligent in caring for Jorge.

On Thursday, September 5, Jorge agreed to a settlement of all her claims against all defendants in exchange for $9.5 million. The settlement was entered in Lowell Superior Court in Lowell, Massachusetts.

NBA Veteran Arrested On Suspicion Of Drunk Driving In California.

In the early hours of the morning on Friday August 30th, 2013, veteran NBA forward Lamar Odom was arrested by the California Highway Patrol in the San Fernando Valley on suspicion of driving under the influence of alcohol.

According to California Highway Patrol officer, Leland Tang, Odom was swerving and driving dangerously when he was pulled over by the police. Odom showed visible signs of intoxication and failed every field sobriety test. After Odom was arrested and delivered to the police station, he refused to submit to chemical tests to determine the level of alcohol in the blood. Pursuant to California Department of Motor Vehicles regulations, Odom’s driver’s license has been suspended for one year for the refusal to submit to the chemical tests. An inventory search of Odom’s car revealed no alcohol, drugs or other contraband.

Odom’s arrest for drunk driving comes on the heels of the worst season of his already declining professional basketball career. Furthermore, Odom’s wife, Khloe Kardashian, has spoken publicly about the couple’s marital problems, including Odom’s alleged cheating.
