Linda Gross, 47, of Watertown, South Dakota, was recently awarded a $7.76 million jury verdict by a New Jersey jury in her lawsuit against health care giant, Johnson & Johnson (“J&J”).
The $7.76 million jury verdict was a punitive damages award against J&J for the personal injuries suffered from their recalled Prolift vaginal mesh product. The defective product was used to treat pelvic organ collapse.
Gross was previously awarded $3.35 million in other monetary compensation by the jury, validating her claim that J&J failed to adequately warn Gross’s doctors about the potential dangers of the vaginal mesh implant.
Gross initiated the suit against J&J back in 2008, alleging that the vaginal mesh implant was not safe, and that J&J was liable for the product’s defective design, manufacture, warnings and instructions.
The Prolift vaginal mesh product was taken off the US market in 2012.
Gross’s case was the first of the hundreds of vaginal mesh cases to be decided that are currently pending in New Jersey courts against J&J.
