A man who was injured falling from a ladder has reached a $4.25 million settlement more than five years after the accident. Lorenzo Cortez, now 44 years-old, was painting a house in Cumming, Georgia when he fell and injured his spinal cord and face. The fall left him a quadriplegic and he developed diabetes and psychological problems. Mr. Cortez spent about a month at the Shepherd Center for the treatment of his spinal injury, and his workers’ compensation paid for an accessible house and interim care. Under the terms of the settlement, Cortez was awarded a lump sum settlement of more than $500,000 and will receive annual payments of $250,000 for the next 15 years, guaranteed to him or his beneficiaries.

A $9.8 million settlement has been awarded to a 35 year-old plaintiff who suffered injuries resulting from defects in his wheelchair. The defective wheelchair personal injury lawsuit alleged the plaintiff was injured as a result of defective design, defective manufacture, inadequate warnings, and faulty repair of the product. The design included bolts on the wheelchair seat frame that were installed with the threaded ends facing away from the wheelchair occupant. After complaints were filed that the bolts were falling out, a design change was made for the bolts to be orientated with the threaded ends facing inward.

The plaintiff later suffered a puncture wound in his lower extremity caused by one of the inward facing bolts. One month later, the wound was aggravated when a seat screw and aluminum seat rail failed, causing the seating area to collapse and eject the plaintiff from his wheelchair. Despite receiving medical treatment for the puncture wound, it has remained open for nearly three years, and the second incident only served to aggravate it.

A Calhoun County, Texas jury awarded Curt Lindsey $200,000 after it found he fell from scaffolding that was improperly constructed. The jury only spent two hours deliberating and found Brand Energy Solutions to be 80% responsible and Formosa Plastics Corporation of Texas 20% responsible for Lindsey’s injuries. Lindsey was working on a piece of equipment at Formosa’s Point Comfort plant when he fell through scaffolding constructed by Brand Energy Solutions. He was flown by helicopter to a hospital in Houston after the 30-foot fall. He was treated for a day and then released. However, he later would require surgery to fix his shoulder.

Initially, the suit was filed against Brand Energy Solutions, but after they named Formosa and Turner Industries Group as responsible third parties, it was amended to include them as well. Allegedly, the evidence showed the scaffolding Lindsey fell through met neither the federal government’s nor Formosa’s safety standards.
