Aaron Deveau, of Haverhill, MA, was the first driver convicted under the criminal Massachusetts’ texting law. He was sentenced to two and a half years for motor vehicle homicide and two years for negligent operation of a motor vehicle causing serious injury while texting, both sentences to run concurrently.
Judge Stephen S. Abany sentenced Deveau after it was determined that he sent 85 text messages before crossing the center line and crashing head-on with a driver on February 20, 2011. Deveau’s Chevy Malibu swerved into a Toyota Corolla driven by 55 year-old Donald Bowley, Jr. from Danville, NH. Bowley suffered massive brain trauma and was removed from life support a little over two weeks after the car accident.
Authorities indicated that one text was sent about a minute before the auto crash at approximately 2:34 p.m. Deveau faced a maximum sentence of four years in prison, but will instead serve one year behind bars for the first case of motor vehicle homicide by texting in Massachusetts.
