California Bicyclist Who Fatally Struck Pedestrian Convicted of Vehicular Manslaughter.

On August 16, 2013, a San Francisco, California-area bicyclist was convicted of felony vehicular manslaughter by bicycle in what is believed to be the first such conviction in the United States.

The conviction stems from a tragic fatal bicycle accident in March 2012. The bicyclist, Chris Bucchere, 37, was riding his bicycle downhill when he entered a crowded intersection in San Francisco’s Castro District and collided with 71 year-old Sutchi Hui, who had been crossing the street with his wife. Bucchere had been riding at about 30 miles per hour at the time of the bike crash and was using a GPS-based application that allows cyclists to compare speed records on a route and to set personal records. Furthermore, witnesses of the collision told authorities Bucchere ran through a red light before slamming into Hui.

According to the San Francisco District Attorney, George Gascón, those witness accounts were a tie-breaking factor in the decision to prosecute the case as a felony.

Gascón further stated that the case was the first felony vehicular manslaughter conviction in the United States against a bicyclist. Under California law, such a conviction would carry a maximum sentence of 6 years in prison. The son of Hui, however, said that he did not want Bucchere to go to prison for the death of his father.

The district attorney has reached a plea deal with Bucchere so as to avoid jail time. The deal provides Bucchere with a sentence of 1,000 hours of community service and 3 years of probation. A judge can decide in six months whether Bucchere’s conviction can be reduced to a misdemeanor.

Young Boy Taken To Hospital After Dog Attack.

A 3 year-old boy was bitten by a Shepherd-retriever mix on the night of August 14, 2013 and was immediately taken to the hospital.

The animal attack occurred in the Wisconsin town of Racine on the 900 block street of Marquete Street at around 7 PM. According to police reports, the dog reportedly belonged to a friend of the boy’s father. The father and his friend were talking when the dog lunged at the boy, causing bite injuries to the boy’s head and upper torso area.

The boy’s extensive personal injuries will require surgery, but they are believed to be non-life threatening.

Drunk Driver Rams Police Car in Head-On Traffic Collision in Massachusetts.

Massachusetts State Police arrested a man from Easthampton, MA last week. He was criminally charged him with drunk driving after he drove his car the wrong way on the Massachusetts Turnpike and into a police cruiser on July 31, 2013. 

Jeffrey Zielenski was arraigned in Westfield District Court and charged with driving under the influence of alcohol, assault and battery with a deadly weapon, negligent operation of a motor vehicle, leaving the scene of an accident including property damage, driving in the wrong direction, and operating to endanger.

Massachusetts State troopers received calls about a driver heading east in the westbound lane of the Massachusetts Turnpike at around 11 p.m. that evening.  Two police cruisers were dispatched to intercept Zielenski, and prevent him from causing any more danger to other drivers on the road, as well as towards himself.  He evaded the police by turning onto the shoulder.  The troopers caught up with Zielenski near Exit 3.  This is where trooper Joseph Tetrault says Zielenski rammed into the police car in a drunken car accident.

The trooper in the vehicle struck by Zielenski was taken to the Noble Hospital emergency room, though he did not sustain life-threatening personal injuries.
