Ms. Jo Huskey was fifty-two years old in 2011 when she was implanted with Ethicon’s Gynecare TVT Obturator to treat stress urinary incontinence, or SUI. Ms. Huskey continues to suffer complications from the vaginal mesh.

As a result, she filed a lawsuit seeking money damages from Ethicon for her pain and suffering, medical expenses and loss of consortium.

A West Virginia jury recently issued a $3.27 million damage award to Ms. Huskey. The jury found that Ethicon was liable for negligence, selling a defective product, and failing to warn patients and doctors of the risks associated with their vaginal mesh product. An additional amount was awarded for Ms. Huskey’s medical expenses and her husband’s loss of consortium.

The Huskey’s suit is one of the first cases to go to trial against Ethicon. Over 21,000 other cases are still pending in the United States District Court for the Southern District of West Virginia.

In addition to Ethicon, other companies are involved as potential defendants, such as Bard Avaulta, Boston Scientific, American Medical Systems, Coloplast, Cook Medical and Neomedical. Some women have had to undergo multiple surgeries and procedures to remove the mesh. However, a lot of the symptoms and pain have not gone away even after the mesh was removed.

Have you or a family member been injured due to a defective product? If so, you may be able to receive money damages for your injuries. Please call us 24/7 at 617-787-3700 to discuss your claim in a free consultation.

On the night of February 15, 2014, NFL star running back Ray Rice was staying at a hotel in Atlantic City, New Jersey.  He was with his then-fiancee, Janay Palmer.  That night, an incident took place that would eventually call into question not only Rice’s football career and reputation, but that of the NFL as well.

The day after the incident, video footage was released on the internet that showed Rice pulling an unconscious Palmer from a hotel elevator.  Though the circumstances were then unknown, there was speculation that the cause of her injuries was domestic abuse.  In late July of 2014, the Baltimore Ravens running back was suspended by the NFL for two games of the regular season after being found to have violated the league’s conduct policy.  Because the details of the incident were not yet known to the public, the outcry was relatively meager.  Many pundits criticized Commissioner Roger Goodell for being too lenient, however, especially in light of some of the recent drug policy violations and suspensions that were meted out as a result.  These suspensions ranged anywhere from four games to an entire season.  As far as Rice and the NFL were concerned, however, the worst was yet to come.

On September 8, 2014, the celebrity news organization called TMZ released a video that showed the actual events of February 15th from inside the elevator.  Before 9:00 am eastern time, the video of Rice’s inexcusable conduct had gone viral.  The video shows Rice and Palmer entering the elevator together.  Then, once the doors have closed in front of them, Rice says something to her, evidently in an angry tone, and then spits on her.  Palmer reacts by half-heartedly slapping her 215-pound fiancée in the face.  She then walks toward him angrily.  Disgustingly, Rice reaches back with his left arm and punches Janay in the face.  The hit is powerful.  Janay’s head jerks back and hits the side of the elevator with alarming force, and she is rendered unconscious.  When the elevator doors open, Rice drags and kicks his fiancee’s motionless body out onto the floor.

After seeing this shockingly graphic video, there was a tidal wave of outrage and criticism from the public and the media.  Many called for the Commissioner’s resignation, hoping that a change of regime would call attention to the plight of abused women everywhere.  Yet no firings have taken place.  Instead, Rice was released by his team, the Baltimore Ravens, and suspended indefinitely by the NFL.  Incredibly, Rice has appealed his suspension, and is considering filing a lawsuit against the league for “double jeopardy.”

Controversy continues to brew over whether or not Roger Goodell had access to the latest video when he ordered Rice’s original two game suspension in July.  An independent investigation regarding the Rice case has been launched by the NFL and is currently being overseen by ex-FBI Director Robert Mueller.

Despite Ray Rice’s celebrity status, his behavior and actions, sadly, reflect that of many American men who do not treat their loved ones with the respect and care that they deserve.  Domestic abuse is an extremely serious problem that must be brought to light.  The effects on the victim can be mentally and physically scarring.

If you or a loved one have been a victim of sexual harassment or domestic abuse, please do not hesitate to pick up the phone and call our Boston attorneys at 617-787-3700.  We are also available, 24/7, by email at info@gilhoylaw.com.  The burden of these terrible ordeals can often be too much to bear.  We can help lighten the load during these difficult times.  Your needs are our top priority!

For more than fifty years, McDonald’s restaurants have been sprouting up across the globe.  McDonald’s is, for many, the gold standard of fast food chains.  The famed “golden arches” can be found in nearly every corner of the world, including third world countries.

In recent years, however, McDonald’s has been forced to change its offerings somewhat in favor of a more health-friendly diet.  While the traditional burger and fries meal still remains popular, our society has become increasingly aware of the harmful effects of the saturated fats, additives, and preservatives that are found in McDonald’s traditional food items.  The problem with making the transition to a healthier menu, however, is that international implementation is difficult.   The source of meat, and the packaging of meats, is particularly important for McDonald’s regarding its new menu items.

Just recently, a video released to the Chinese media showed footage of a meat-processing plant in Shanghai.  The plant, which supplied chicken and beef to McDonald’s in Japan, used appalling practices and procedures.  The video shows workers picking meat up off the factory floor and using it in shipments.   Workers in the video also claimed that the meat smelled bad.  The Shanghai Municipal Food and Drug Administration subsequently found that expired beef and chicken products were being processed at the plant and repackaged with new expiration dates.

McDonald’s has officially cut off all shipments from the Chinese factory, which is owned by an Illinois-based company, namely the OSI Group.  This same factory also provides meats to other large chains, such as KFC and Starbucks.

According to McDonald’s CEO, Sarah Kasanova, the loss of the Shanghai supplier will account for a 20% drop in sales in the Japanese market.  In the meantime, McDonald’s will buy its meat from Thailand.  Kasanova apologized for the use of the tainted meat, and declared that the practices shown on the viral video were not condoned by the company and never would be.  On behalf of McDonald’s, she also promised to strengthen food safety measures, including more transparency in the country of origin for its products.
