It doesn’t take an engineering degree to understand how stability in motor vehicles works.  “18-wheelers,” formally known as tractor trailer trucks, are incredibly stable because they are heavy and voluminous—18 wheels to support the sheer weight of whatever cargo they happen to be carrying.  But in some instances, a tire will blow out and the truck will continue traveling safely.  Most regular automobiles have four wheels, and do not have the luxury of being able to lose one.

For motorcycles, this principle is even more critical.  Two wheels and a lightweight frame combine to create the “perfect storm” of danger.  In other words, motorcycles are very dangerous because they are often unstable and can reach high rates of speed.  Motorcycle accidents often cause major injuries to victims, including broken bones and severe head trauma.

On August 11, 2014, 49-year-old Gilberto Montoya was riding his motorcycle on the Sussex Turnpike in Randolph, New Jersey.  At around 6:45 pm, he was stopped at a traffic light.  Coming up behind him in a Honda Civic was 73-year-old Paul Rishap.  Unfortunately, the elderly man did not see Mr. Montoya on the motorcycle ahead of him.  His car struck the back of Mr. Montoya’s bike and launched him into the air.  He landed on the pavement more than thirty feet away, where his helmet came off.  As a result of the crash, Mr. Montoya suffered a major head injury that caused paralysis on the entire left side of his body.

After leaving the hospital, Mr. Montoya and his family decided to file a personal injury lawsuit against Mr. Rishap and his insurance company, New Jersey Manufacturers.  After a brief period of litigation, the insurance provider recently agreed to settle the case with Mr. Montoya for the full policy amount of $500,000.  According to the settlement, the money is to be held in a special needs trust for the benefit of Mr. Montoya during his lifetime.  Representing the plaintiff in this case was Marc Futterweit.

For the Montoya family and thousands of others, the sting felt by such a traumatic event will forever remain.  In cases such as this one, the emotional and psychological consequences for victims’ families can be staggering.  Easing the burdens through legal representation is, therefore, the best option for many families.  If you have been wrongfully deprived of a loved one, contact our Massachusetts motorcycle injury attorneys who will help you find the peace and closure that you deserve.  Your needs are our top priority!

Like a car, our bodies are not designed to last forever.  Eventually, we have no other choice but to “repair” or “replace” parts of our body that no longer function properly.  Medical technology, thankfully, has made incredible strides in the past several decades.  With several exceptions, we can now replace a malfunctioning joint or organ with surgery.  The implications for the distant future are bright indeed.  We are now pioneering our way into a new age of biomedicine.

But there are also pitfalls in this new area of medicine.  Many of the materials that we use to create new implants, and other similar devices, are subject to human error.  Manufacturing them, in other words, can present new problems.  If the implants are not designed to be safe in the human body, there can be severe negative consequences.

The Stryker Corporation, an American medical technology company, has recently come under fire for the failure of its Rejuvenate hip implants.  According to the allegations in a class action lawsuit filed by patients with the implant, the devices were reportedly corroding and causing inflammation in tissue in and around the implant.  In 2012, Stryker made the decision to recall all of its implants in order to prevent any further backlash.  Unfortunately, by that time, thousands of Americans had already suffered injuries due to their defective hip implants.

Stryker has recently agreed to a settlement to pay $300,000 to each of the plaintiffs for each hip implant that required a revision surgery.  The settlement is estimated to include roughly 3,000 patients, which would mean that Stryker would stand to lose nearly $900 million from the lawsuit. “We estimate that it will cover about 3,000 patients whose devices have already failed,” Ellen Relkin, a plaintiffs attorney in the New Jersey case, said in an interview.

The damage caused by a defective product can be serious and long lasting.  If you or a loved one have endured this kind of pain and anguish, your suffering must be brought to an end.  With an experienced personal injury attorney at your side, you may be able to find the financial security that was robbed of you at the time of the accident.  Please call 617-787-3700 to tell us about your potential claim today.  Your needs are our top priority!

Despite great advances in both training and education, doctors are still capable of human errors and human carelessness. Due to the importance of their positions, however, a doctor’s negligence can often result in serious injury or even a wrongful death. This is why the courts in every jurisdiction of the United States have strict and extensive rules and regulations, in addition to common law, regarding the nature, content and scope of medical malpractice. In part, these rules and regulations have been created to encourage doctors to use the highest levels of care that are available in their treatment of patients.

In a recent news article, CNN’s chief medical corespondent, Dr. Sanjay Gupta, listed hospital errors and infections at hospitals as one of “America’s 9 biggest health issues.” While statistics show that less people are dying from medical errors now than in the past, approximately 200,000 Americans still die annually from preventable medical errors, including harmful facility-acquired conditions, and millions more experience errors causing injuries other than death. Furthermore, medical errors cost the United States nearly $20 billion a year, the vast majority of which expenditures come from additional medical costs that are necessitated by these mistakes in professional care. Unfortunately, this cost is usually paid by the victim of the error, and often without the aid of insurance. That is one of the many reasons why it is crucial to have strong legal representation to protect and uphold your interests after a medical error.

If you or a family member have experienced injuries, including pain and suffering, due to the negligence of your doctor, you may be entitled to substantial compensation. Massachusetts medical malpractice victims are generally awarded money compensation for lost wages, medical expense reimbursement and rehabilitation expenses, among other damages. We are experts in the field. Call us at 617-787-3700, 24/7, or email us at info@gilhoylaw.com. Time may be a factor in pursuing your claim, so please contact us today!
