Ikea Issues Massive Product Recall of Dressers and Chests After Causing Multiple Injuries and Fatalities.

According to the Consumer Product Safety Commission, the federal government’s watchdog agency, a child is sent to the emergency room by a falling piece of furniture or a falling television every twenty-four minutes.  Once every two weeks, one of those injuries is fatal.  To prevent this, there are strict regulations and guidelines about the design and safety of furniture and other products.  When these guidelines are not adhered to, a product has an increased likelihood for harm, and the manufacturer may be held accountable for that harm.

A recent example of this is Ikea, which just ordered a recall of nearly thirty million dressers and chests because they reportedly have a high likelihood of tipping over and injuring young children.  According to nbcnews.com, there have been three fatalities already associated with the specific line of furniture being recalled.  Ikea has recalled the models in question and offered free anchoring kits so customers can fasten the furniture to the wall.  But for some, this may be too little, too late.   The complaints and injuries over the furniture spanned a period of two years before Ikea ordered a recall.  If it can be shown that they were negligent in their design or recall of the furniture, they may be held financially responsible for the injuries caused.

Massachusetts Woman Awarded $2 Million in Personal Injury Damages After Surgical Error.

Surgery can be a scary experience.  Whether it is a routine procedure or a lifesaving emergency, every patient puts a great deal of faith and trust into all of the doctors and nurses involved.   Aside from the primary surgeon and their assistants, every major surgery also has an anesthesiologist. During a surgical procedure, the anesthesiologist will continually monitor and control the patient’s vitals (heart rate and rhythm, breathing, blood pressure, body temperature and body fluid balance) and adjust the amount of anesthetic medication according to the patient’s needs.  It is a crucial role that requires years of medical school and further training to perform successfully.  Since it is such a crucial role, if it is done improperly, serious injury or even death can occur.

Unfortunately, one Massachusetts woman did not receive the duty of care from her anesthesiologist that was expected, which consequently caused her serious harm.  The forty-one-year-old woman, who asked to remain anonymous, underwent surgery to have an intrathecal catheter implanted to cope with her long-standing pain in her left leg.  An intrathecal catheter is a thin plastic tube that is inserted into the base of the spine and connects to a small pump to allow doctors to administer painkillers and medication directly to a patient’s spinal fluid.  The implantation was successful, but after the surgery, the woman complained of feeling numbness in her legs and feet.

The next day, the woman returned to the hospital; neurological tests showed that the catheter had punctured part of her spine, causing nerve damage.  The catheter was removed, but the woman lost significant feeling in her feet and legs and now has bilateral paraplegia, which severely limits her mobility. During an investigation, it was revealed that the woman’s anesthesiologist had placed the catheter several vertebrae higher than what medical standards recommend.  Furthermore, in a post-surgery report, the anesthesiologist recorded that he placed the catheter lower than where it actually was, and did not alert any other doctors of any possible complications.  The woman filed a personal injury lawsuit, arguing that her anesthesiologist’s actions were negligent and caused her injuries.  A jury agreed with her, and ordered the doctor and hospital to pay her $2 million dollars to compensate her for her injuries.

Two Lawsuits Filed Against South Carolina Department of Transportation and Horry County After Two Men Crash Their Motorcycles on an Allegedly Unsafe Road Surface.

Poor road conditions, often due to weather or defects, are a major problem for motorcycle riders.  Hydroplaning or a bump in the pavement can be enough to wipe out a motorcycle.  In addition, a motorcycle accident victim has little structural protection to prevent him or her from sustaining serious injuries in the event of an accident.  For this reason, approximately 80% of motorcycle accidents result in injury or death, four times higher than the comparable rate for automobiles. 

On May 12, 2015, Randolph MacKenzie was traveling north on International Drive in Carolina Forest, South Carolina.  As MacKenzie was driving, the road surface changed from a paved road to coquina.  The unstable road conditions caused him to suddenly lose control of his motorcycle and crash.  MacKenzie suffered severe injuries from the accident.  He filed a lawsuit against the South Carolina Department of Transportation and Horry County for damages related to his injuries.

Another lawsuit was filed by Teresa Toronto, the personal representative for the estate of James Toronto Sr. On August 31, 2015, James Toronto was driving his motorcycle on International Drive, when he crashed shortly after the spot where the road transitions from asphalt to coquina.  Toronto passed away from his injuries eight days after the accident.

Both lawsuits allege that the defendants, South Carolina Department of Transportation and Horry County, were negligent in allowing the road to fall into disrepair, failing to properly inspect and maintain the road, leaving it in an unreasonably hazardous and unsafe condition, failing to properly mark the road or have proper signage, failing to warn motorists of the change of surfaces, and failing to repair the dangerous conditions when they knew or should have known that they existed.  Attorney Charles V.
