Professional Football Player Awarded Over $400,000 After Being Assaulted By Another Player On The Field.

Baseball may be considered America’s favorite pastime, but football is America’s most dominating and watched sport.  In 2015, 26 of the top 27 programs were professional football games, with only the first Republican primary debate interrupting football’s dominance with an appearance at number 13.  Perhaps it is the spectacle of complicated plays or the physicality of the athletes, but whatever the reasons, the NFL draws in tens of millions of viewers every weekend.  Football is known for its aggressive plays, and despite safety equipment and precautions, injuries do arise.  Each and every player assumes the risk of injury when they walk onto the field that they may tear a ligament, get a concussion, or break a bone.  In fact, violence is inherent to the sport.  There are rules of play, however, and overly aggressive behavior is unacceptable even on a football field.

Former Raider’s linebacker Bill Romanowski is an example of such unacceptable behavior. During a practice drill, Romanowski got into an argument with his teammate, tight end Marcus Williams.  Romanowski was reportedly angered that Williams had held onto him during a block and started to shove and shout at Williams on the sideline after the play was over.  According to Espn.com, Romanowski stepped toward Williams and grabbed his face mask. Williams grabbed back before quickly letting go. But Romanowski continued pushing on Williams’s helmet—so violently that his head jerked back. As Williams’s helmet flew off and his head recoiled forward, Romanowski’s right fist smashed into his face. Williams fell to the ground unconscious, his left eye socket shattered and with a chipped tooth.

As a result of the punch, Williams was unable to return to football as his face healed and he faced a difficult time as well regarding returning to the field after that as his head trauma may make him a high-risk player for concussions.  To recover for his medical bills, pain and suffering, and lost income, Williams filed a personal injury lawsuit against Romanowksi.  After a one week trail, a local jury found in Williams’s favor and awarded him $340,000 in lost wages, $40,000 in medical expenses, and $75,000 in other damages.

Employers have the  responsibility of creating a safe, controlled work environment.  When an employer fails to abide by state-mandated guidelines, they expose their employees to severe injury or even death.   That employer is then liable for the injuries that befall their employees.

This responsibility applies to all employers, regardless of the work, whether it be a construction site, retailer store, or a multi-million dollar movie set.  After a decade of waiting, Star Wars fans were ecstatic to finally be getting another film in the blockbuster franchise with Star Wars Episode VII: The Force Awakens.  One of the main draws of the film was the return of much of the cast from the original 1977 Star Wars, including Harrison Ford as Han Solo.  A mistake on the set, however, almost made it a very tragic return for Ford.

While shooting one of the film’s scenes aboard the Millennium Falcon, one of the hydraulic doors malfunctioned and closed sharply on top of Ford.  He was able to avoid the door slightly, but the large steel plate came crushing down on Ford’s leg, shattering his tibia and fibula like a “blunt-edged guillotine.”  Ford was rushed to a nearby hospital.  After several months of recovery, he was able to resume shooting. According to io9.gizmodo.com, the movie set reportedly violated several workplace safety rules and film producers were fined nearly $1.96 million for safety violations.  They are also potentially liable for any personal injury lawsuit filed against them by Ford, himself, for the injuries he sustained.

Asbestos was once a highly common product used in manufacturing in the twentieth century. It was cheap, readily available, and also was praised for its insulation abilities and durability.  After decades of frequent use, however, scientists learned—all too painfully— of the severely harmful effects of inhaling asbestos dust and spores.  Exposure to asbestos dust and fiber can result in asbestosis, a chronic medical condition affecting lung tissue which makes breathing extremely difficult, in addition to other diseases.

Because of its extreme harm to humans, asbestos is heavily regulated in its use and storage.  When companies violate these regulations, they not only put their employees at risk, but also may face hefty fines.  US Steel has recently been fined $170,000 by OSHA (the Occupational Safety and Health Administration) for reportedly exposing its workers to asbestos. An investigation revealed that workers removed and replaced packing material containing asbestos and were instructed to burn and remove rotten sections of pipe that tested positive for asbestos.

After its investigation, OSHA cited the company for a total of ten violations of worker safety laws.  Chris Robinson, the director of OSHA involved in the investigation, told wtae.com: “once again, we have found U.S. Steel Corp. failed to protect its employees from the serious risks of asbestos exposure. Breathing airborne asbestos fibers can cause lung damage that often progresses to disability and possible death.”   This is the second time, since 2011, that OSHA has cited US Steel for exposing its employees to asbestos hazards.

If you or a family member have been injured by asbestos exposure, you may be entitled to substantial compensation for your injuries, as well as any emotional trauma and financial hardship caused by the illegal exposure. Call us 24/7 at 617-787-3700, or email us at info@gilhoylaw.com for your free and private consultation.
