Nevada Jury Awards Surgeon’s Family $19 Million In Damages After Fatal Bicycle Accident.

Bicycles tend to be one of the more convenient ways of getting from point a to point b, but they are also riskier than motor vehicles because they offer very little protection. While riding a bicycle, however, an operator has the right to use specified bike lanes, roads and crosswalks, without fear of being struck by a motor vehicle. If a vehicle does negligently enter your bike lane and causes you to have an accident, you may be entitled to just compensation equal to the amount of your medical expenses, lost earning capacity, pain and suffering and other damages. However, a personal injury lawsuit is complicated, which is why victims of bicycle accidents should listen to the expert Boston bicycle accident attorneys at our firm who have decades of experience. Las Vegas, Nevada jurors awarded nearly $19 million to the family of a hand surgeon who was killed after being struck and swept under a bus while on a bike because of a flaw in the vehicle’s aerodynamic design. The family was represented in the case by Nevada lawyer, William Kemp. Dr. Kayvan Khiabani, the 51 year-old head of hand and microsurgery at the University of Nevada, Reno, School of Medicine and the chief of hand surgery at the University Medical Center, died less than a year ago while cycling near the Red Rock Resort. Witnesses in April told police that Dr. Khiabani was pedaling his bicycle alongside a Motor Coach Industries tour bus when he appeared to accidentally veer left.

The quick move caused his bike’s handlebar to bump into the bus’s passenger side before Dr. Khiabani fell into the vehicle’s path. After a five-week trial and less than a day of deliberation, jurors found that the bus company failed to provide adequate warning of the damages associated with the design of the bus. The jury awarded a total of $16.2 million to Dr. Khiabani’s sons, Keon, 14 years-old, and Aria, 16 years-old, along with $2.5 million to the estate of his wife, Dr. Katy Barin, a dentist who died in October after a battle with cancer.
