Nevada Jury Awards Surgeon’s Family $19 Million In Damages After Fatal Bicycle Accident.

Bicycles tend to be one of the more convenient ways of getting from point a to point b, but they are also riskier than motor vehicles because they offer very little protection. While riding a bicycle, however, an operator has the right to use specified bike lanes, roads and crosswalks, without fear of being struck by a motor vehicle. If a vehicle does negligently enter your bike lane and causes you to have an accident, you may be entitled to just compensation equal to the amount of your medical expenses, lost earning capacity, pain and suffering and other damages. However, a personal injury lawsuit is complicated, which is why victims of bicycle accidents should listen to the expert Boston bicycle accident attorneys at our firm who have decades of experience. Las Vegas, Nevada jurors awarded nearly $19 million to the family of a hand surgeon who was killed after being struck and swept under a bus while on a bike because of a flaw in the vehicle’s aerodynamic design. The family was represented in the case by Nevada lawyer, William Kemp. Dr. Kayvan Khiabani, the 51 year-old head of hand and microsurgery at the University of Nevada, Reno, School of Medicine and the chief of hand surgery at the University Medical Center, died less than a year ago while cycling near the Red Rock Resort. Witnesses in April told police that Dr. Khiabani was pedaling his bicycle alongside a Motor Coach Industries tour bus when he appeared to accidentally veer left.

The quick move caused his bike’s handlebar to bump into the bus’s passenger side before Dr. Khiabani fell into the vehicle’s path. After a five-week trial and less than a day of deliberation, jurors found that the bus company failed to provide adequate warning of the damages associated with the design of the bus. The jury awarded a total of $16.2 million to Dr. Khiabani’s sons, Keon, 14 years-old, and Aria, 16 years-old, along with $2.5 million to the estate of his wife, Dr. Katy Barin, a dentist who died in October after a battle with cancer.

Two of the teenagers are 16 years-old and the third is a 15 year-old.

According to court documents, the Boomerang lawsuits were settled for $2,432.89 and $3,121.10, respectively. The other lawsuit was related to injuries sustained when a tree branch fell on the victim near the Old Chicago Train Station. That was settled for $10,000. Per Missouri law, any serious injury sustained on an amusement park ride must be immediately reported to the State Fire Marshall. The operator of the ride must also cease operation until the Missouri Department of Public Safety has determined that the ride is safe for public use.

Attorney For Woman In Sexual Harassment Lawsuit Against Google Seeks To Turn Case Into Class Action For All Alleged Female Google Harassment Victims.

A lawsuit brought by a former Google employee, who says that the company’s “bro culture” led to daily sexual harassment, is being expanded as a class action after Google tried to push the case into sealed, secret arbitration. Loretta Lee, a software engineer, was fired from her role at Google in February 2016 after eight years at the firm. Her lawsuit claims that she had raised complaints about sexual harassment and had sought medical leave shortly before she was fired.

The plaintiff alleges that her male co-workers spiked her drinks with alcohol, shot nerf darts at her, and made sexual comments to her. One co-worker texted her asking for a horizontal hug, while another hid under her desk. On Friday, attorneys representing Google tried to have Lee’s lawsuit dismissed and forced into arbitration, which would have prevented it from proceeding in the public eye, in stark contrast to Microsoft, which recently ended its practice of enforcing arbitration agreements in cases of sexual harassment.

Here, at the Law Offices of Gilbert R. Hoy, Jr. and Affiliates, you’ll find experienced Massachusetts sexual harassment lawyers who are more than capable of helping you through the complicated process of filing a lawsuit and recovering fair and just pecuniary damages. Victims of unlawful sexual harassment are entitled to collect money damages for the injuries they have suffered as a result of the harassment.
