Former Georgia Ethics Director Wins $700,000 Jury Verdict in Workplace Retaliation Lawsuit.

Stacey Kalberman, the former director of the Georgia State Ethics Commission, has been awarded $700,000 in compensation after a jury found that she was discriminated against for investigating complaints against Georgia Governor Nathan Deal.

The jury found that Kalberman’s salary was cut, and that her deputy director, Sherilyn Streicker, was fired after they conducted investigations into Governor Deal’s campaign reports and financial disclosures from 2010.  According to the lawsuit, Kalberman presented draft subpoenas in the Deal investigation to the board of commissioners for the Georgia State Ethics Commission at a May 3, 2011 meeting, asking the commissioners to authorize the issuance of the subpoenas.  Kalberman then allegedly began to notice changes in her employment, including her salary cut and the elimination of her deputy’s position.

Georgia’s current Ethics Director, Holly LaBerge, also testified at trial, stating that she was contacted by a member of Governor Deal’s office just a short time later in mid-May 2011, asking if she’d be interested in taking over Kalberman’s job. LaBerge was then contacted by the board of commissioners about the job, all of which occurred before the opening had been publicly posted and before Kalberman’s salary was cut.

The Georgia Attorney General had defended the State in the case, claiming that the salary cut and position elimination were both the result of state budget concerns.  The jury, however, agreed with Kalberman and her attorney, Kim Worth, who argued that the decisions were in direct retaliation for Kalberman’s zealous investigation into the complaints against Deal, and awarded her $700,000 in damages, as well as attorneys’ fees and back pay.

Kalberman’s former deputy, Streicker, is also suing the state for workplace retaliation.

Deal has been cleared of any major violations in that investigation, but he was forced to pay $3,350 in administrative fees.  Deal is a Republican, and he is seeking re-election in the state’s gubernatorial race this year.

Stomach Reducing Surgery May Be Key To Solving The Problem Of “Diabesity.”

A study reported this past Monday, March 31, 2014 at the American College of Cardiology conference, and published in the New England Journal of Medicine, has revealed that stomach reducing “obesity surgery” has an extremely positive effect on reducing blood sugar levels and reducing the patient’s need for insulin injections.

When this study initially began, researchers and physicians dealing with the problem of “diabesity” did not hold out much hope. “Diabesity” is the ultra-dangerous combination of Type 2 diabetes and obesity, which results in very poor outcomes for most patients. In fact, patients with such a condition have traditionally been unable to produce sufficient amounts of insulin to even digest food. The available treatment has consisted mainly of a series of medications that have not fully helped to alleviate the symptoms of diabetes nor provided any meaningful hope for something resembling a cure.

Several years ago, stomach reduction surgery was floated as a means of killing two birds with one stone, namely reducing the person’s weight and reducing the person’s sugar levels. Doctors like Dr. Robert Siegel from Cedars-Sinai Medical Center in Los Angeles were very skeptical. But the results of the recently completed three-year study have been dramatic. Over 90% of the patients that had the surgery no longer required insulin injections, whereas 55% of the patients in the medication group still required insulin shots. Dr. Siegel has stated that he “did not dream” of such effects from the surgery.

The study’s lead authors are hoping to begin implementing the surgery nationwide, in an attempt to combat the epidemic that is the combination of obesity and diabetes.

Metalworker Who Lost Fingers Files Product Liability Suit.

Albert Mueller, of Levittown, Pennsylvania, has filed a lawsuit against Tennsmith Inc. claiming a device they manufactured, the Tennsmith metal shearer, caused him to lose three of his fingers in a metal work accident.

Mueller was working at Sherwood Steel Inc. in Pennsylvania as a metalworker when he was severely and irreversibly injured. As a part of his job in the metal fabrication department, he was required to use a Tennsmith metal shearer. While he was using the Tennsmith product, he lost his right index, right middle and right ring finger. All three fingers were completely amputated by the device.

According to the lawsuit, the amputations occurred on Mueller’s right hand—his dominant hand, making the injuries even more devastating and debilitating. To date, Mueller has needed surgery, physical therapy and other medical care to treat his injuries. In addition to physical pain, Mueller is claiming mental anguish and other pain and suffering. He is seeking more than $150,000 in damages plus attorney’s fees, interest, costs and delay damages.
