Red Bull gives you wings!  The famous energy drink company has advertised with this catchy slogan for more than a decade. Its strongly caffeinated drinks are now found in nearly every grocery store and convenience store in the nation.  Despite the company’s ability to sponsor manned “space jumps” and other high-octane stunts, it has recently been discovered that the drink does not, figuratively speaking, give you wings.  Instead, a class action lawsuit was filed in 2013 against the company for falsely advertising the drinks’ abilities to boost performance and reaction speed.  On October 13, 2014, the two sides finally reached a settlement in the amount of $13 million.

According to the settlement agreement, Americans who purchased Red Bull between 2002 and 2012 are eligible to receive financial compensation.  There are two options for compensation.  The first is $10, and the second is a free 4-pack of Red Bull.  Eligible claimants are required to submit their application before March 1, 2015 in order to receive compensation.  Many people are puzzled at this arbitrary figure of $13 million and also that there is no obvious way to prove the purchase or consumption of Red Bull in such a large time frame.  Also complicating the issue is the fact that the company says it sold 5.387 billion cans worldwide last year.

Dogs are commonly referred to as “man’s best friend,” and for good reason. A dog can be a large and integral part of any close family, and often forms a long lasting relationship with its owners. But, dogs are still fundamentally animals, with animal instincts and tendencies. An otherwise well-mannered or trained dog may still have the capacity to harm, which is why there is a strict standard of liability on the dog’s owner to secure and monitor his or her dog.

A man who knows all-too-well what can happen to a non-secured dog is Joshua Walsh, a police officer from Durham Country, NC. Officer Walsh was responding to a routine call in early October, 2011. He was accompanied by his partner, Deputy Carson, and his canine Frisco, a Belgian Malinois. Walsh was able to catch and apprehend a fleeing suspect. But, while handcuffing him to the ground, Deputy Carson lost control of Frisco, who violently bit Walsh in the leg and calf.

The attack resulted in Officer Walsh needing to receive medical treatment for months, two of which he was incapable of working or generating an income from his second job. Besides the emotional and mental trauma stemming from the event, Walsh is suffering from a loss of sensation in his leg and is suing his department to be justly compensated.

While one would expect that a police dog would be well trained and under control, multiple dog handling experts have expressed concern in the quality and expertise of K-9 Unit trainers in North Carolina, which does not require police dogs to be certified. The Belgian Malinois has gained popularity in recent years with the police and military because of its intelligence, loyalty, and strength. The breed is comparable to a German Shepherd, and has gained notoriety for its effectiveness in Afghanistan and Iraq. Despite the intelligence and loyalty of the breed, Frisco attacked another officer, but the blame may not rest on the dog. Retired police chief and national executive director of the Springboro, Ohio-based U.S. Police Canine Association was quoted saying: “[t]here are no dog mistakes, only handler mistakes.”

Barbara Mihalich has filed a lawsuit on behalf of herself and others who have used Johnson and Johnson’s talcum powder in the past five years in the Southern District of Illinois Court. She alleges that consumers were not adequately warned about the risks of using the power. Allegedly, the powder carries a much higher risk of ovarian cancer for women that use it.

Ms. Mihalich alleges that the talcum powder and the baby powder are not safe for genital dusting. Women who used the powder in their genital area allegedly have a 33% increased risk of developing ovarian cancer, compared to those who do not use the powders.

The lawsuit states that Johnson and Johnson misrepresented their product regarding the safety of the powder.

The defendants have answered that Ms. Mihalich was not injured by the powder and has never developed any injuries stemming from the product.
