Alabama Family Awarded $16 Million In Medical Malpractice Lawsuit.

Medical malpractice is never acceptable. As patients, we need to feel that we are safe while in the hands of medical professionals. This may be especially true when a woman goes into labor because it is not only her safety but the safety of the unborn child that is at risk. When a medical professional violates his or her duty of care and you are harmed, it is important that you explore your legal rights. The experienced medical malpractice attorneys here at the Law Offices of Gilbert R. Hoy, Jr. and Affiliates have decades of experience fighting for our Massachusetts clients.

Caroline Malatesta was preparing to have her fourth child and was determined to have a natural birth experience. That was why she chose Brookwood Women’s Center in Birmingham, Alabama. Ms. Malatesta’s pregnancy, however, was allegedly nothing like what was advertised by Brookwood, which claimed to be a “Your Birth, Your Way” type of facility.

Ms. Malatesta was not only restrained during labor but she was unable to use the birthing methods which Brookwood claimed were top-notch. After her water broke, a nurse reportedly forcefully delayed labor by holding the child’s head inside the mother after he had crowned. Ms. Malatesta experienced extreme pain and developed pudendal neuralgia, a condition affecting the nerves in the pelvis.

Ms. Malatesta now lives permanently with pudendal neuralgia and experiences bouts of chronic pain, a diminished sex life, and loss of energy and mobility. In August 2016, an Alabama jury ruled in favor of the Malatestas, ruling that the hospital had violated its standard of care. The Malatestas were awarded $11 million in compensatory damages, as well as $5 million in punitive damages for the reckless fraud that was found by the jury due to the hospital’s misrepresentation of facts.

An unexpected rescuer, in Australia, saved a mother and another person who were being attacked by two dogs. The attack happened in Atherton Tablelands and the dogs involved in the attack were domesticated. At the time of the dog attack, Katrina Tewes was on her way home. She was close to Burrawong Avenue in n Yungaburra when two dogs approached her. She described the moment: “The two dogs came towards me and started circling me, and then they attacked.” Before rescuers came to assist the woman, the attack had lasted a good five minutes. Barry Hubbard, a 76-year-old, was in his house when he heard screams; he later said that he thought it was a bunch of kids playing. When he went to go check to see if everything was fine, he saw a horrible scene. Barry described the situation: “I didn’t know what was going on, so I went down the side of this house and was confronted with two vicious dogs… They were both covered in blood.” Barry then rushed to help Mrs. Tewes without thinking about himself. Another rescuer, Neville Vaughan, also intervened. All three of the people involved were brought shortly thereafter to the Atherton District Hospital. Mrs. Tewes received 15 punctures on her arms and legs and Neville had several wounds. Mr. Hubbard will receive plastic surgery to repair his lower legs because he was injured during his heroic rescue.

If you or a loved one has been injured because of a dog, you can be awarded personal injury damages to compensate you for your pain and suffering and all other damages. United Airlines Faces Public Backlash After Customer Is Violently Removed From Aircraft Due To Overbooking.

United Airlines has been the latest target of public anger following an incident involving a customer on one of their flights. On April 9th, 2017, a day just like any other, Dr. David Dao boarded a United Airlines flight in Chicago bound for Louisville, Kentucky. Shortly after the flight was fully boarded and just before takeoff, United staff came on board and notified the passengers that the flight was overbooked. They asked for 5 volunteers to give up their seats to United employees in exchange for travel vouchers and hotel accommodations. No one volunteered, and that’s when things took a turn for the worse.

Because no passengers would volunteer their seats, the airline randomly selected 5 passengers to give up their seat—Dr. David Dao was one of them. While the other 4 passengers left willingly, Dr. Dao refused, stating that he was not getting off the plane because he had to see patients in the morning. The situation escalated, and aviation authorities were called onto the plane to forcibly remove Dr. Dao from his seat. With cell phone cameras rolling, the authorities ripped him from his seat and dragged him down the aisle of the aircraft. He allegedly suffered a broken nose and a concussion during the removal.

In the wake of the incident, United Airlines has faced huge public backlash and criticism for how their staff handled the situation. The company has also seen a drop in their stock prices. Dr. Dao and his attorneys have released a public statement indicating that he intends to file a personal injury lawsuit against the airlines for the injuries he sustained.

If you or a loved one has been injured in an aviation accident, you may be entitled to substantial financial compensation for your medical expenses and pain and suffering.
