Lawsuit Targets Homeowners’ Association For Negligently Maintained Playground.

One of the most frightening aspects of tragic stories that appear on the news is that they make us realize that it does not take extraordinary circumstances for tragedy to strike. These stories reflect the fact that seemingly harmless, innocuous, every day activities can quickly devolve and become a cautionary tale. The number of car accidents per year alone is enough to alert the public about the dangers of a common activity such as driving, yet that only comprises a fraction of the stories of accidents caused by negligent behavior that lead to serious injury. In such a situation, it would be wise to contact an expert personal injury attorney at 617-787-3700.

When 13 year-old Carl Thompson went to sit down on a swing set in his community playground, he simply needed a place to relax and send out a text message. As soon as he sat down, however, his whole world changed. A 42-pound crossbar that connected all the swings fell down on Thompson. Part of his skull was crushed, and he was left with permanent brain damages and depression.

Now, Thomas is bringing a lawsuit against the involved Homeowners’ Association (HOA) for failing to properly maintain the swing set. According to the allegations of the complaint, the HOA would have only needed to spend $150 per month on an inspector, and this whole accident could have been avoided. To put that into context, the HOA spent $160,000 this past year on various inspections. HOA president Art Sonjoa testified in court that an inspector had indeed approached the HOA, but they decided that it was not worth the money. Thomas is represented by attorney Sean Claggett, who plans to introduce evidence showing that the deteriorated state of the swing set has been obvious for quite some time, and that the HOA was negligent in not taking precautions sooner.

Lawsuit Alleges That Negligence By Pilots Contributed To 2017 Plane Crash.

While traveling via airplane still causes anxiety in some, most people are aware by now that planes are actually an extremely safe form of transportation. Considering the number of flights that occur per day, airplane accidents are incredibly rare. Airport security measures are also thorough and extensive, as anyone who has ever stood in a TSA security line will know. Because of how safe airplanes actually are, when an accident does occur, it is very likely that human error played some role. In legal terms, this human error may amount to negligence, which is particularly important if the accident resulted in injuries or damages of any kind. In such a situation, it may be wise to contact an expert personal injury attorney at 617-787-3700.

On May 15, 2017, a small jet flying to Teterboro Airport in New Jersey crashed, causing several loud explosions and fires near the airport. Witnesses to the crash said that they saw the jet coming in very low and hitting power lines, as well as clipping buildings above a densely populated area. The two men piloting the plane, who were also its only passengers, died in the crash. Fortunately, and somewhat miraculously, according to authorities, no one on the ground was injured as a result of the crash.

However, according to a lawsuit filed in Superior Court in Hackensack, New Jersey, a building owned by the United Paper & Ribbons Corporation was severely damaged by fire and debris. The suit, which was brought by Selective Insurance, claims that the co-pilot was inexperienced and should not have been at the controls at all when the crash occurred. Selective Insurance argues that this was a substantial contributing factor to the crash, and is looking to recover $15,000 in damages.

Immigrant Mother Files Lawsuit On Behalf Of Son Who Was Injured At A Detention Center.

At the moment, there is arguably no issue more divisive in America than the separation of migrant families at the U.S. border. Many Americans are deeply troubled and saddened by President Trump’s separation of so many small children from their parents. Stories are going around of many young children being torn away from their parents, and then sent thousands of miles away, causing trauma for both parties. Opponents of President Trump’s policies surrounding immigration have vehemently protested these practices. In addition, the detention centers that children are sent to when they are separated from their families have come under scrutiny for poor conditions and harsh treatment of the kids.

In one recently reported case, a mother and son were coming to America to escape domestic abuse when they were separated immediately after crossing the U.S. border. The child, Geremy, was taken to a detention center. While there, he was reportedly bullied viciously by other children, and at one point, had to be taken to the hospital to be treated for wounds on his head after another boy pushed him into a bed post. Geremy’s mother is now filing a lawsuit against the detention center, claiming it was negligent in ignoring Geremy’s complaints about the bullies, and failing to take him to the hospital in a timely manner. Her attorney is Dallas LaPierre of Nexus Derechos Humanos.

This is not the first negligence suit filed against a detention center. In one case, a child did not receive care after falling and fracturing his arm. There have also been several reports of an unidentified individual injecting an unknown substance into children at a detention center in Chicago. Heartland Alliance, an organization that supplies many of these centers, has expressed concern over these allegations, although they reportedly do not believe that such allegations reflect the true nature of what occurs at these facilities.
