Alabama Family Awarded $16 Million In Medical Malpractice Lawsuit.

Caroline Malatesta was preparing to have her fourth child and was determined to have a natural birth experience. That was why she chose Brookwood Women’s Center in Birmingham, Alabama. Ms. Malatesta’s pregnancy, however, was allegedly nothing like what was advertised by Brookwood, which claimed to be a “Your Birth, Your Way” type of facility.

Ms. Malatesta was not only restrained during labor but she was unable to use the birthing methods which Brookwood claimed were top-notch. After her water broke, a nurse reportedly forcefully delayed labor by holding the child’s head inside the mother after he had crowned. Ms. Malatesta experienced extreme pain and developed pudendal neuralgia, a condition affecting the nerves in the pelvis.

Ms. Malatesta now lives permanently with pudendal neuralgia and experiences bouts of chronic pain, a diminished sex life, and loss of energy and mobility. In August 2016, an Alabama jury ruled in favor of the Malatestas, ruling that the hospital had violated its standard of care. The Malatestas were awarded $11 million in compensatory damages, as well as $5 million in punitive damages for the reckless fraud that was found by the jury due to the hospital’s misrepresentation of facts.
